Kevin is Board Certified in Intellectual Property Law by The Florida Bar, and is "AV" rated by Martindale-Hubbell. He has been practicing exclusively in the field of intellectual property law, and has been a registered patent attorney since 1987. His experience includes patent, trademark, copyright, trade secret, unfair competition and computer and internet law. He has represented plaintiffs and defendants in many complex patent, trademark and copyright disputes, and has obtained hundreds of patents and trademark and copyright registrations. Kevin is the editor of the International Trademark Association's Treatise, Florida Chapter, entitled "State Trademark and Unfair Competition Law." He is Of Counsel to GrayRobinson.
Kevin's practice focuses primarily on procuring, enforcing and counseling clients in connection with utility and design patents, trademarks, copyrights, trade dress, unfair competition, trade secrets and Internet matters across the United States. He represents clients' interests in all federal courts in the country and in inter partes proceedings before the Trademark Trial and Appeal Board of the United States Patent and Trademark Office.
As a registered Patent Attorney, Kevin's practice includes conducting patentability and infringement investigations, preparation and rendering opinions on those investigations, and preparation and prosecution of utility and design patent applications (both domestic and international). Kevin has prosecuted hundreds of patent applications, including reissue applications, and has been involved in many reexamination proceedings and appeals before the United States Patent and Trademark Office.
Kevin's trademark practice involves conducting registerability and clearance-to-use investigations, and securing registrations for clients' trade and service marks both in the US and abroad. He counsels clients in the selection, adoption, use, licensing and enforcement of their marks.
Kevin's copyright practice includes procuring and enforcing copyright registrations for original works of authorship, and defending claims of copyright infringement. He has litigated copyright infringement claims in a diverse range of fields, including those involving software, architectural drawings and photographic works.
Kevin counsels clients in connection with contractual matters, and regularly negotiates and drafts licensing, settlement, software, website hosting, work for hire and employment agreements. He has conducted large scale due diligence investigations in connection with mergers, asset sales and entity acquisitions. Kevin is experienced in drafting and negotiating licenses and transfers of all forms of intellectual property.
