Intellectual Property
Stearns Weaver Miller has a wide-ranging Intellectual Property practice. Our lawyers have broad experience handling complex business and legal issues relating to patents, trademarks, copyrights, domain names, and trade secrets. We specialize in the prosecution, protection, and strategic management of intellectual property assets at every stage of business.
Our extensive trial experience, coupled with our transactional and prosecution backgrounds, gives us a distinct advantage in litigation. We aggressively enforce and defend intellectual property rights in federal and state courts throughout the country, as well as in the U.S. Patent and Trademark Office and before the Trademark Trial and Appeal Board. We have successfully handled countless trials and appeals regarding patent, trademark, copyright, unfair competition, trade secrets, breach of contract, and other business and commercial matters. We also routinely obtain injunctions and writs of seizure to close down infringing activities, and can prevent infringing products from being imported into the United States.
Patents
Infringement of a patent consists of the unauthorized making, using, offering for sale or selling any patented invention within the United States or United States Territories, or importing into the United States of any patented invention during the term of the patent. If a patent is infringed, the patentee may sue for relief in the appropriate Federal court. We are skilled litigators in the field of patent infringement. Aside from understanding the unique challenges associated with patent litigation, our lawyers bring substantial technical and scientific knowledge to the most complex matters.
Trademarks
We advise small and large businesses, in a wide range of industries and fields, on their current trademark portfolios as well as the selection of new marks. We recognize the importance of selecting and cultivating a trademark. In today’s global market, trademark owners must protect these assets in order to maximize the value of their brand significance in the eye of the consumer. We work with our clients to strategically select, protect, enforce, or license their trademarks while working to minimize the legal and business risks associated with their branding strategy. Our extensive experience, practical and proactive approach enable us to streamline the process of protecting our clients’ most valuable assets.
Copyright
Stearns Weaver Miller offers a wide range of services including copyright prosecution, licensing and litigation. We have expertise in drafting and negotiating complex copyright-related transactions and we assist our clients with litigation in areas ranging from software to artistic and literary works.
Internet Law
With the increase in electronic commerce, registering domain names and protecting trademarks on the Internet is an increasing concern for our clients. These concerns include cybersquatting, domain tasting and domain kiting. We advise small and large businesses of their rights against third parties who register confusingly similar domain names and/or use our clients’ marks on their web sites without authorization. We successfully protect our clients in both federal and state courts and through Uniform Dispute Resolution Policy arbitration authorized by the Internet Corporation for Assigned Names and Numbers (ICANN). As a result, our clients have obtained injunctive relief and monetary damages, and have recovered domain names registered by cybersquatters.
